Do all probate disputes go to trial?

July 23, 2026 – Daniel A. Seigel

Some disputes are resolved through settlement discussions, mediation, or negotiated agreements, while others continue through litigation in court. In Broward County probate litigation cases, mediation, a form of alternative dispute resolution, is often required before a final trial. Whether a matter proceeds to a hearing or trial often depends on the issues involved, the available evidence, and whether the parties can reach a resolution. Trust proceedings may also be brought as judicial proceedings under the Florida Trust Code when trust administration is in dispute.
