Possible resolutions include the court upholding the existing beneficiary designation or voiding it if sufficient evidence of misconduct is presented. If the designation is voided, the court may direct that the assets be distributed according to the terms of the deceased’s will or trust, or as per Florida’s intestacy laws if no valid will exists. Settlements outside of court are also possible, depending on the circumstances.
