What happens if a will or trust is successfully contested in Boca Raton, Florida?
November 28, 2024 – Daniel A. Seigel
If a will or trust is successfully contested, the court may invalidate the entire document or specific provisions that are found to be invalid. If a will is completely invalidated and there is no prior valid will, the estate will be distributed according to Florida’s intestacy laws. If only certain provisions are invalidated, the remaining valid parts of the will or trust will be executed according to the decedent’s wishes.
